TERMS OF USE


The Colorado State Tobacco Education & Prevention Partnership in the Colorado Department of the Public Health and Environment (the Department), in conjunction with its contractor, Cactus Communications Inc. (CCI), is promoting an interactive website-based program aimed at the prevention and cessation of tobacco use by youth, named Own Your C ("OYC"). References to the Department throughout this Agreement include the activities of CCI as the Department’s contractor. Through OYC, the Department operates a website located at the domain name www.ownyourC.com (the "Site"). This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your access and use of the Site. By accessing or using the Site, you agree to abide by all applicable laws and be bound by the terms of this Agreement. Please read this Agreement and save it. If you do not wish to be bound by this Agreement, you may not access or use the Site. You must read this Agreement and indicate your acceptance during the registration process.

This Agreement includes the Department's policy for acceptable use of the features on the Site and Content (as defined in Section 8 below) posted on or through the Site and your rights, obligations and restrictions regarding your use of the Site and Content posted on or through the Site.

You can also review the most current version of the Agreement at any time by clicking on the Terms of Use link from any page on the Site. The Department may modify this Agreement from time to time and such modification shall be effective upon posting by the Department on the Site. Your continued use of the Site after the Department posts a revised Agreement signifies your acceptance of the revised Agreement. It is therefore important that you review this Agreement regularly to ensure you are aware of any changes to this Agreement.

Please choose carefully the information you post on or through the Site and that you provide to other users of the Site. You may not post on or supply the Site any form of prohibited Content, as outlined in Section 11 below. Despite this prohibition, information, materials, products or services provided by other users may, in whole or in part, be unauthorized, impermissible or otherwise violate this Agreement, and the Department assumes no responsibility or liability for this material. If you become aware of misuse of the Site by any person, please click support@ownyourc.com to contact Own Your C.

The Department reserves the right, in its sole discretion, to reject, refuse to post or remove any posting by you, or to deny, restrict, suspend, or terminate your access to all or any part of the Site at any time, for any or no reason, with or without prior notice or explanation, and without liability. The Department expressly reserves the right to remove and/or deny, restrict, suspend, or terminate your access to all or any part of the Site if the Department, in its sole discretion, determines that you have violated this Agreement or pose a threat to the Department and/or its users. The Department hopes that you will find the information provided on the Site informative and useful. The Department is pleased to provide the information on the Site conditioned upon your acceptance, without modification, of the terms, conditions and notices contained in this Agreement. Please feel free to e-mail the Department with your thoughts about the Site or to request more information about OYC.

1. Access to the Site. The Department is providing you with the information and functionality in the Site. You are responsible for providing all equipment necessary to establish a connection to the World Wide Web, access to the World Wide Web, and any telephone or other connection and service fees associated with such access.

2. Eligibility for Use. Use of the Site and registration to be a "Member" for purposes of participating in OYC and posting materials in the Site ("Membership") is void where prohibited. By using the Site, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 13 years of age or older; and (d) your use of the Site does not violate any applicable law or regulation. Your Member profile may be deleted and your Membership may be terminated without warning, if the Department believes that you are under 13 years of age, if the Department believes that you are under 18 years of age and you represent yourself as 18 or older, or if the Department believes you are over 18 and represent yourself as under 18.

3. Site User Obligations. In consideration of your use of the Site, you agree to provide true, accurate, current and complete information about yourself as prompted and you further agree that you will not use the Site for any purpose that is unlawful or prohibited by the Agreement. If you provide any information that is untrue, inaccurate, not current or incomplete, or if the Department has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the Department has the right to refuse any and all current or future use of the Site (or any portion thereof). The Site is for the personal use of visitors. As set forth more fully in Section 11 below, the Department reserves the right to remove any "Content" (as defined in Section 8 below) in its sole discretion. Illegal and/or unauthorized use of the Site, including collecting usernames, user id numbers, and/or email addresses by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Site, or employing third party promotional sites or software to promote profiles for money, is prohibited. The Department reserves the right to take appropriate legal action for any illegal or unauthorized use of the Site.

4. Account and Password Security. The Department may allow Site users to select a password and account designation upon completing a registration process for Membership or an online service provided through the Site (the "Service"). You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password and account. You agree to (i) immediately notify the Department of any unauthorized use of your password or account or any breach of security and (ii) ensure that you fully exit from your account at the end of each session. The Department is not be liable for any loss or damage arising from your failure to comply with this provision. You are fully responsible for maintaining the confidentiality of your password and account, and for all activities that occur under your password or account.

5. Use of Interactive Areas. The Site may contain "Interactive Areas," including chat rooms, bulletin boards, or other message and communications features to which you agree to post only messages or other information that are proper, lawful, and related to the particular Interactive Area. In addition, but without limitation, you may not post content that:

The Department reserves the right to review, edit, or delete any content you post to this Site and to terminate your access to any Interactive Area at any time without notice for any reason whatsoever.

You acknowledge that all Interactive Areas are public and not private communications; therefore, any information or content you post to an Interactive Area may be read by others. The Department recommends against the posting of any personally identifiable information. The Department does not endorse or control the content, messages or information found in any Interactive Area and, therefore, the Department specifically disclaims any liability with regard to the Interactive Areas and any actions resulting from your participation in them. Interactive Area hosts are not necessarily employees or affiliates of the Department, and their views do not necessarily reflect those of the Department.

7. State Governmental Immunity. Notwithstanding any other provision to the contrary, no term or condition of this Agreement shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protection or other provisions of the Colorado Governmental Immunity Act, Section 24-10-101 et.seq., CRS, as now or hereafter amended. The parties understand and agree that liability for claims for injuries to persons or property arising out of negligence of the State of Colorado, its departments, institutions, agencies, boards, officials and employees is controlled and limited by the provisions of Section 24-10-101 et. seq., CRS and the risk management status, section 24-30-1501, et seq., CRS as now or hereafter amended.

8. No Representations Regarding Site Content. It is solely your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, statements, representations, services, and other information provided through the Site, including via text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials (collectively, "Content"). The Department does not endorse or represent the reliability, accuracy or quality of any information, goods, services or products displayed or advertised on the Site. The Department makes no representations or warranties, express or implied, with respect to the information provided on the Site.

9. Proprietary Rights in the Content. You acknowledge and agree that Content contained in the Site or information presented to you through the Site may be protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by the Department or its affiliates, you agree not to modify, distribute, copy, reproduce or create derivative works based on the proprietary portions of this Site, in whole or in part.

Those portions of the Site owned by the Department are the copyright of the Department. You may not upload, embed, post, email, transmit or otherwise make available any material that infringes any copyright, patent, trademark, trade secret or other proprietary rights of any person or entity, including that which belongs to the Department. Content belonging to the Department is protected by copyright, trademark, patent, trade secret and other laws, and the Department owns and retains all rights in such Content. OYC, OWN YOUR C, and www.ownyourC.com are trademarks of the Department. All other trademarks are the property of their respective owners.

The Department performs technical functions necessary to maintain the Site, including but not limited to transcoding and/or reformatting Content to allow its use throughout the Site.

10. Proprietary Rights Regarding Member Content. The Department does not claim any ownership rights in the Content that you post on or through the Site ("Member Content"). After posting your Member Content to the Site, you continue to retain any such rights that you may have in your Member Content, subject to the limited license herein. By displaying or publishing any Member Content on or through the Site, you hereby grant to the Department a limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce, and distribute such Member Content, including without limitation distributing part or all of the Member Content in any media formats and through any media channels. You also hereby grant each user of the Site a non-exclusive license to access your Member Content through the Site, and to use, reproduce, distribute, display and perform such Member Content as permitted through the functionality of the Site and under these Terms of Use. The license you grant to the Department is non-exclusive, perpetual, fully-paid and royalty-free, and worldwide.

You represent and warrant that: (i) you own the Member Content posted by you on or through the Site or otherwise have the right to grant the license set forth in this Section 10, and (ii) the posting of your Member Content on or through the Site does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. You agree to pay for all royalties, fees, and any other monies owing any person or entity by reason of any Member Content posted by you on or through the Site.

11. Prohibited Content/Activities. The Department may reject, refuse to post, or delete any Member Content for any or no reason, including Content that in the sole judgment of the Department violates this Agreement or which may be offensive, illegal or violate the rights of any person or entity, or harm or threaten the safety of any person or entity. The Department assumes no responsibility for monitoring the Site for inappropriate Content, including any Member Content, or conduct. If at any time the Department chooses, in its sole discretion, to monitor the Site, the Department nonetheless assumes no responsibility for the Content, including any Member conduct, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the visitor or Member submitting any such Content.

The following are examples of the kind of Content that is illegal or prohibited to post on or through the Site. The Department reserves the right to investigate and take appropriate legal action against anyone who, in the Department’s sole discretion, violates this provision, including without limitation, removing the offending Content from the Site and terminating the Membership of such violators. Prohibited Content includes, but is not limited to, Content that, in the sole discretion of the Department:

The Department reserves the right to investigate and take appropriate legal action against anyone who, in the Department’s sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities. 12. Notice and Procedure for Copyright Infringement Claim. Pursuant to 17 U.S.C. Section 512, as amended by Title II of the Digital Millennium Copyright Act (the "Act"), the Department reserves the right, but not the obligation, to terminate your right to use the Site if the Department determines in its sole and absolute discretion that you are involved in any activity that may be infringing, including alleged acts of infringement, regardless of whether the material or activity is ultimately determined to be infringing. The Department accommodates and does not interfere with standard technical measures used by copyright owners to protect their materials. In addition, pursuant to 17 U.S.C. Section 512(c), as amended, the Department has implemented procedures for receiving written notification of claimed infringements and for processing such claims in accordance with the Act. The designated agent of the Department (the "Agent") to receive notification of claimed infringement is:

The Department respects the intellectual property of others, and the Department asks Site users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide the Agent listed above the following information: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest; (ii) a description and identification of the copyrighted work or other intellectual property that you claim has been infringed; (iii) a description of where the material that you claim is infringing is located on the Site; (iv) your address, telephone number, and email address; (v) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

13. Links to Third Party Sites. The material and links to third-party websites and resources that may be included on the Site are provided for informational purposes only. Providing links to these sites by us should not be interpreted as endorsement or approval by the Department of the organizations sponsoring these sites or their products or services. The Department makes no representations or warranties, express or implied, with respect to the information provided on this Site or any third-party website which may be accessed by a link from this Site, including any representations or warranties as to accuracy or completeness. Because the Department has no control over third-party websites and resources, you acknowledge and agree that the Department is not responsible for the information and contents of such third-party websites and does not endorse and is not responsible or liable for any content, statements, representations, advertising, products, services or other materials on or available from such sites or resources. You further acknowledge and agree that the Department shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused in connection with your use or reliance on any such content, information, goods, or services available on or through any such site or resource.

14. No Reproduction or Resale. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Site, use of the Site, or access to the Site.

15. Indemnification. You agree to indemnify and hold the Department, its directors, officers, employees, agents, contractors, co-branders or other partners harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Site, your connection to the Site, your violation of the Agreement, your breach of your representations and warranties set forth in this Agreement, your posting of any Content through the Site that causes the Department to be liable to another, or your infringement of any intellectual property or other right of any other person or entity.

16. Enforcement. The Department does not assume responsibility to you or others for any failure by the Department to enforce the provisions contained in the Agreement.

17. Termination. You agree that the Department has the sole discretion, with or without notice, to terminate your use of the Site (or any part thereof) for any reason, including, without limitation, for lack of use or if the Department believes that you have violated or acted inconsistently with the letter or spirit of the Agreement. The Department may also in its sole discretion and at any time discontinue providing the Site, or any part thereof, with or without notice. You agree that any termination of your access to the Site under any provision of the Agreement may be effected without prior notice, and acknowledge and agree that the Department may immediately bar any further access to the Site. Further, you agree that the Department shall not be liable to you or any third party for any termination of your access to the Site.

18. General Acknowledgments. You acknowledge that the Department may establish general practices and limits concerning your use of the Site. You agree that the Department has no responsibility or liability for the failure of the Site and the deletion of other content maintained or transmitted by the Site. The Department reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Site (or any part thereof) with or without notice. You agree that the Department shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Site. You further acknowledge that the Department reserves the right to change these general practices and limits at any time, in our sole discretion, with or without notice.

19. Privacy. The terms and conditions of the Department’s Privacy Policy are located at www.ownyourc.com and are incorporated herein by reference. In the event of a conflict between the terms of this Agreement and those in the Privacy Policy, the terms of the Privacy Policy shall govern.

20. DISCLAIMER OF WARRANTIES. YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

EXCLUSIONS AND LIMITATIONS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

21. Governing Law. The Agreement and the relationship between you and the Department shall be governed by and construed in accordance with the laws of the State of Colorado without regard to its conflict of laws analysis. You and the Department agree to submit to the exclusive jurisdiction of the courts located within the State of Colorado to resolve any dispute arising out of the Agreement. EACH OF THE PARTIES HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVES ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY LITIGATION (INCLUDING BUT NOT LIMITED TO ANY CLAIMS, COUNTERCLAIMS, CROSS-CLAIMS, OR THIRD PARTY CLAIMS) ARISING OUT OF, UNDER OR IN CONNECTION WITH THIS AGREEMENT. FURTHER, EACH PARTY HERETO CERTIFIES THAT NO REPRESENTATIVE OR AGENT OF EITHER PARTY HAS REPRESENTED, EXPRESSLY OR OTHERWISE, THAT SUCH PARTY WOULD NOT IN THE EVENT OF SUCH LITIGATION, SEEK TO ENFORCE THIS WAIVER OF RIGHT TO JURY TRIAL PROVISION. EACH OF THE PARTIES ACKNOWLEDGES THAT THIS SECTION IS A MATERIAL INDUCEMENT FOR THE OTHER PARTY ENTERING INTO THIS AGREEMENT.

22. Waiver. The Department’s failure to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed to by the Department in writing.

23. Severability. If any provision of the Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in such provision, and, notwithstanding such finding, all other provisions of the Agreement shall remain in full force and effect.

24. Time Limitation. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the Agreement or use of the Site must be filed within one (1) year after such claim or cause of action arose or be forever barred.

25. Headings. The section headings and sub-headings contained in the Agreement are for convenience only and have no legal or contractual effect.

27. Other. This Agreement is accepted upon your use of the Site and is further affirmed by you becoming a Member. This Agreement constitutes the entire agreement between you and the Department regarding the use of the Site.

PRIVACY POLICY


Effective October 30, 2008:

The Colorado's State Tobacco Education & Prevention Partnership in the Colorado Department of Public Health and Environment (the Department), in conjunction with its contractor, Cactus Communications Inc. (CCI), is promoting an interactive website-based program aimed at the cessation of smoking by youth, named Own Your C ("OYC"). References to the Department throughout this Agreement include the activities of CCI as the Department’s contractor.

This privacy policy of the Department (the "Privacy Policy") describes the privacy practices for the State's OYC web site, located at the domain name www.ownyourC.com (the "Site"). The purpose of this Privacy Policy is to inform you about the types of information gathered about you when you visit this Site, information received from third parties or affiliates, how that information may be used or disclosed, and the choices you have regarding our use of, and your ability to correct, the information.

The Department supports the protection of individual privacy and strives to help its supporters and other visitors of the Site protect their privacy while using this Site. The Department wants to make your online experience satisfying and safe.

This Privacy Policy does not apply to other websites that are accessible through this Site. Please be aware that any advertisers, sponsors, affiliated entities and other third-party websites accessible through this Site may have their own privacy and data collection policies and practices. Neither the Department nor its contractor is responsible for any actions or policies of such third parties. You should check the applicable privacy policies of those third parties when providing personally identifiable information through such linked websites.

MINORS

The Site is a general audience site and does not knowingly collect information from children under 13 years of age.

MODIFICATION OF THE PRIVACY POLICY

From time to time the Department may modify this Privacy Policy to reflect industry initiatives or changes in the law, our information collection and use practices, the features of the Site, or technology, and such modifications shall be effective upon posting by the Department on the Site. Your continued use of the Site after the Department posts a revised Privacy Policy signifies your acceptance of the revised Privacy Policy; therefore, it is important that you review this Privacy Policy regularly to ensure you are updated as to any changes. If the Department materially changes its practices regarding collection or use of your information, your information will continue to be governed by the Privacy Policy under which it was collected unless you have been provided notice of, and have not objected to, the change.

GOVERNMENTAL IMMUNITY

Notwithstanding any other provision to the contrary, no term or condition of this Agreement shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protection or other provisions of the Colorado Governmental Immunity Act, Section 24-10-101 et. seq., CRS, as now or hereafter amended. The parties understand and agree that liability for claims for injuries to persons or property arising out of negligence of the State of Colorado, its departments, institutions, agencies, boards, officials and employees is controlled and limited by the provisions of Section 24-10-101 et. seq., CRS and the risk management status, section 24-30-1501, et seq., CRS as now or hereafter amended.

APPLICATION OF THE STATE OPEN RECORDS ACT

Pursuant to Part 2 of Title 24, Article 72, of the Colorado Revised Statutes regarding public records, which applies to this Privacy Policy, all public records shall be open for inspection by any person at reasonable times, except as set forth in 24-72-201, CRS et. seq., CRS, as now or hereafter amended.

COLLECTION OF YOUR INFORMATION

The Department collects no personal information, such as an individual's name, date of birth, gender, zip code, mailing address, or email address, about you unless you voluntarily participate in an activity on the Site that asks for personal information. If you choose not to participate in these activities, your choice will not affect your ability to use any other features of this Site.

The Department collects information from applications or personal correspondence, such as emails or letters that you send, and you may be asked to voluntarily provide personal information on this Site. If personal information is requested on the Site or volunteered by the user, state and federal law may protect it. However, this information is a public record once you provide it, and may be subject to public inspection and copying if not protected by federal or state law.

You can visit the Site without registering as a member with OYC ("Member" or "Membership"). You can also contact us about a particular video or other posting on the Site without being a Member.

However, certain other activities on the Site, such as uploading text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials ("Content") require you to be a Member. The Site asks for some personal information when you create a Membership account, including your email address and a password, which is used to protect your account from unauthorized access, date of birth, gender, and zip code. The Department also may store your responses to questions posed as part of the OYC program. As a Member, you are allowed to access many of the services that are offered in conjunction with the OYC program and that require registration, including the posting of Content on the Site. In becoming a Member, however, please note that you will have to divulge some personal information. Any personal information or Content that you voluntarily disclose online (on discussion boards, in messages and chat areas) becomes publicly available and can be collected and used by others.

The Department may collect some information about your visit to the Site, including:

The information collected or stored is used to improve the content of our web services and to help us understand how people are using these services.

If during your visit to the Site you send an email to the Department, the following information will be collected: (1) the email address you used in sending the email; and, (2) the contents of the email. To better serve Site users, the Department may use "cookies" to customize your browsing experience with us. Cookies are simple text files stored on your computer by your web browser. They provide a method of distinguishing among visitors to the Site.

Cookies created on your computer by using this Site do not contain personally identifying information and do not compromise your privacy or security. We use the cookie feature only to store a randomly generated identifying tag on your computer. You can refuse the cookie or delete the cookie file from your computer by using any of the widely available methods. Site services are provided in such a way that the use of cookies is not mandatory.

In addition to cookies, the Department may use other now known or later developed technologies, including web beacons or web bugs, to assist the Department in observing the behavior of users visiting the Site. These technologies access individual user information but the information is used only to compile aggregated statistics about the Site's usage.

USE OF YOUR INFORMATION

If you submit personally identifiable information to the Site, the Department uses your personal information to operate, maintain, and provide to you the general and personalized features and functionality of the Site and as generally part of the OYC program, and to process any flagging activity or correspondence you send.

The Department may use the information collected from you to provide services that you have requested. The Department may also use your personal information to send you targeted messages, publications, news, and information about events, special offers, and promotions. The Department may also use third-party service providers to send and distribute email and to perform other marketing and support functions. The Department may use information automatically collected from you to improve the content of this Site, to enhance users' experiences when visiting this Site, and to customize the content and layout of this Site for each individual user.

SHARING YOUR INFORMATION

The Department may share your personal information with select third parties who offer goods or services that may be of interest to you. From time to time, we may partner with other organizations or companies to provide co-sponsored or co-branded promotions, services or events and may share your personal information with our co-sponsor. Use of shared information is subject to third parties' policies.

The Department also may share with third parties aggregated demographic and statistical information that is not personally identifiable.

The Department may be required to use or disclose your information in connection with a legal action or other proceeding, including without limitation, in response to a court order or a subpoena. The Department also may disclose such information in response to a law enforcement agency's request.

The Department may make chat rooms, forums, message boards, and/or news groups available to our users through the Site. Some of these forums require registration. Please remember that any information that is disclosed in these areas becomes public information, and you should exercise caution when deciding to disclose your personal information.

Department employees, agents and contractors must have a business reason to obtain access to your information and may share your personal information only with those who help us manage or provide OYC activities (for example, message board administration, order fulfillment, statistical analyses, data processing), or with outside contractors, agents or sponsors who help with the administration of OYC program items. These outside contractors, agents or sponsors may temporarily store some information on their servers, but they may only use your personal information to provide the Department with a specific service and not for any other purpose. This opt-out provision shall in no way limit the Department's rights set forth above to disclose your information to enforce or preserve our rights under the law.

STORING YOUR INFORMATION

The Department is committed to protecting the security of any personal information you provide to us. We safeguard information according to established security standards and procedures. After you have submitted your information online, we recommend that you end your browser session before leaving your computer.

In spite of these protections, the Department cannot guarantee the security of any data submitted over the Internet. After your information reaches the Department, however, it is stored on servers (or in the case of information received from you in person, in writing or over the phone, in storage areas) protected by procedures and technology designed to block reasonably foreseeable intrusions by unauthorized third parties.

The Site may list or contain links to other websites. The Department is not responsible for the privacy practices of such websites and will not be a party to or responsible for any transactions between you and such third parties. The Department encourages our users to be aware when they leave the Site and to read the privacy statements of each and every website that you visit. This Privacy Policy applies solely to information collected by the Department.

PROCEDURE FOR COPYRIGHT INFRINGEMENT CLAIM

Pursuant to 17 U.S.C. Section 512, as amended by Title II of the Digital Millennium Copyright Act (the "Act"), the Department reserves the right, but not the obligation, to terminate your right to use the Site if the Department determines in its sole and absolute discretion that you are involved in any activity that may be infringing, including alleged acts of infringement, regardless of whether the material or activity is ultimately determined to be infringing. The Department accommodates and does not interfere with standard technical measures used by copyright owners to protect their materials. In addition, pursuant to 17 U.S.C. Section 512(c), as amended, the Department has implemented procedures for receiving written notification of claimed infringements and for processing such claims in accordance with the Act. The Department respects the intellectual property of others, and asks Site users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide the Agent listed above the following information: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest; (ii) a description and identification of the copyrighted work or other intellectual property that you claim has been infringed; (iii) a description of where the material that you claim is infringing is located on the Site; (iv) your address, telephone number, and email address; (v) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

CHANGES TO MEMBERSHIP INFORMATION

Whenever possible, OYC Members may review their registration information maintained about them in our records. The Department will take reasonable steps to correct any information a Member informs the Department is incorrect.
